All holidays are provided by Europe-Active company (“the Company”, “we”, “our” or “us”) and are sold subject to our general conditions of sale.
Your enrolment onto one of our holidays will be taken into account only upon receipt of your filled and signed reservation if it is made by mail, or filled and validated reservation if it is made on our website, and this is only so long as there is availability for your holiday at the time we receive your reservation.
This reservation must be accompanied by a 30% deposit of the total amount of the holiday if the reservation takes place more than 30 days before the departure or if the reservation takes place less than 30 days before departure we require a deposit of 100% of the total amount of the holiday. The balance must be paid one month before the beginning of the holiday. For holidays outside of Europe, the final balance for the holiday must be paid 45 days before the beginning of the holiday.
Holiday reservation including a Europe Active vehicle rental
If your holiday package includes the rental of a vehicle (motorcycle, bicycle, car) owned by Europe Active, a non-refundable deposit will be included within the 30% deposit (or within the balance if you pay the full price). The non-refundable deposit amount is 30€ per bicycle, 100€ per 50cc scooter or 125cc motorcycle and 200€ per motorcycle above 125cc. In case the non-refundable deposit is higher than the 30% deposit, you'll need to pay the non-refundable deposit.
In case of cancellation on your part (except when you find a suitable and willing replacement), the cancellation fee will be kept by Europe-Active (except for holidays outside of Europe):
- More than 30 days before the departure: 100 € per person for set-up fees.
- Between 29 and 16 days before the departure: 50% of the full price of your holiday.
- Between 15 and 2 days before the departure: 90% of the full price of your holiday.
- Less than 2 days before the departure: 100% of the full price of your holiday.
Holidays outside of Europe:
- More than 45 days before departure: 30% of the full price of your holiday.
- Less than 45 days: 100% of the full price of your holiday.
Do not forget to inform us immediately of your need to cancel your holiday so that we can validate your date of cancellation.
You (the participant) can have your deposit back if you have subscribed to our cancellation insurance and if the reason of the cancellation is within the insurance contract.
In case a participant(s) does not present him/herself at the welcome meeting (if any) starting the holiday, or cannot show the necessary travel documents or health documents required for the holiday (passport, visa, certificate of vaccination etc), no refund will be made.
Attention: concerning the reservation of transportation to and from the place of your holiday such as ferry, train or plane, and especially for low-cost carriers, it is important to note that we intervene only as an intermediary and that in this case, the conditions of cancellation are to be seen directly with these companies and are not our responsibility; in conclusion, the expenses concerning your means of transport will be invoiced to you as well as the cancellation fee for Europe Active. Only the particular and general conditions of sale will be to take into account in case of cancellation or problem.
Additional cancellation fees may apply for all tailor made holidays when some provider's cancellation conditions require non refundable deposits.
The interruption of a holiday by a participant cannot give rise to a refund. See the conditions of repayment proposed by your insurance.
Modification of your holiday
With more than 30 days before the departure, if you wish to change your holiday or the date of your holiday, a lump sum of 50€ will be retained per person. With less than 30 days before departure, any modification of your holiday will be regarded as a cancellation and the higher expenses of cancellation presented will apply.
Any modification of your holiday that involves Europe Active contracting the services of external people (for example, the hiring of vehicles, air transport, maritime transport etc) and creates expenses in modification will be the responsibility of the customer in addition to the expenses retained by Europe Active and described previously.
If your holiday is cancelled by us because the minimum number of participants is not reached, or as a result of conditions questioning the safety of the participants, or for a case of absolute necessity and it is at least 21 days before the departure, you will be proposed, in the majority of the cases at least, a formula for replacement. If this formula is not convenient for you, you will be entirely refunded.
The price of the holiday is the one announced on the www.europe-active.com website. The services inclusive and not inclusive during the holiday are specified in the description presenting the holiday. Supplements and reductions are usually available on the same descriptive page.
Dates of departure confirmed on the web sites of the agency
The departure dates posted on the web site are subject to definitive confirmation of the participants. This information is regularly updated. The departure dates are there to facilitate your choice of reservation and are not contractual.
You benefit of a right of access to your information. The website Europe Active is officially the object of a declaration with the CNIL.
Any contestation or dispute must be carried out in front of the commercial court of Bastia.
Europe Active cannot replace the several liabilities for each participant. Each participant must take responsibility for obtaining all of the documents necessary for the successful completion of the holiday (for example, identity papers, authorizations, visas, vaccines).
Each participant is responsible for his own luggage and must ensure his luggage is present before and after every transfer.
As a tour operator, Europe Active works with various people providing services and receiving benefits (hotel keepers, managers of accommodation, carriers, various other people receiving benefits) and must not be confused with these other providers who retain their appropriate responsibility.
Our holidays include for the most part activities in the open air and in nature and are activities presenting risks inherent to the practice of the activities themselves. Each participant assumes these risks in full knowledge of the facts and makes a commitment not to make Europe Active, the guides or the various providers involved, carry the responsibility of the accidents or the incidents which can arise in the normal frame of the activities. This clause also applies to any legal successor and to the members of the family of the participant.
Every participant has to conform to the rules of prudence and follow the advice given by the guide representing the agency, who cannot be considered as the person responsible for the accidents resulting from the carelessness of a member of the group.
Europe Active reserves the right, if particular circumstances questioning the safety of the group demand it, to modify the route or certain services of the program, directly or through the guide. The independent holidays are routes sold without a guide. The fixed price includes a description of the route and a map presenting the area. The independent holidays thus involve a suitable knowledge of map reading and orientation.
Every participant has to conform to the rules of prudence and follow the advice given by the topo-guide or route notes. Europe Active cannot be considered as the person responsible for the accidents resulting from the carelessness of a participant. Neither can Europe Active be considered as person in charge of a bad interpretation of the description or an error of reading the map of the user (in particular for meteorological reasons). The independent holiday supposes the acceptance of a risk, which can be due, in particular, to a modification of elements on the route. Consequently, every participant makes a commitment to accept this risk and not to make Europe Active, or the various providers, carry the responsibility of the accidents or the incidents which can arise. This clause also applies to any legal successor and to the members of the family of the participant in question.
According to the regulations of our profession, we are insured in Professional Civil liability. However we would not substitute ourselves for the Personal Civil liability that every participant has to hold in person.
It is indispensable for a participant to possess an individual insurance for multi-risk and multi-activity holidays (expenses of cancellation, research - help, repatriation, medical expenses, theft of luggage, etc.) adapted well to the activities to be undertaken as part of the holiday.
The insurance assistance from which many participants benefit in a general contract is often minimal. This type of coverage is rarely adapted to the types of holidays that we propose.
The Europe Active group is the only company in Corsica to have the French equivalent of an ATOL bond. So, if our company closes down, disappointed customers will be guaranteed a refund for their holiday. In addition, the French equivalent of an ATOL bond offers additional financial protection: it covers every single type of holiday and not just flight inclusive holidays.
Rental from external companies
In case of rental (car, motorbike, or any other form of equipment) entered into with external companies, it is the rental conditions of the external company that will apply for the duration of your holiday with Europe-Active. The rental conditions of the external company supplement and do not replace the full conditions of sale described here. Europe-Active acts as an intermediary between the client and the external company only.
